Delhi HC orders MTP for 22-week pregnant rape victim

The Delhi High Court has permitted the restorative end of pregnancy of a minor assault survivor 22 weeks into her pregnancy, considering the mental and psychological complications.

The bench of Judge Vibhu Bakhru ordered this after considering the report of the restorative board constituted by it to assess the hazard of proceeding
with the pregnancy. The report shown that the pregnancy was 22 gestational weeks with a margin of mistake of plus/minus two weeks.

The FIR was lodged at the concerned police station beneath Section 376 IPC and Section 6 of Protection of Children i.e. Security of the children from Sexual Offences Act, 2012. The casualty need to know the news of her pregnancy exceptionally late and since presently she was at an progressed arrange of pregnancy, the end of pregnancy by the concerned specialists

The court, after association with the casualty through video-conferencing, found that she was “under impressive distress”. Thus the court has ordered that the casualty be conceded to Dr Ram Manohar Lohia Healing center for therapeutic end of the pregnancy, subject to the results of certain tests to show any included risk.
