Petition In SC Seeks Compensation For Wrongful Prosecution and Incarceration

A petition has been filed before the Supreme Court asking directions to Government to make law for compensation and rehabilitation of the people who are acquitted having been in jail for the wrongful prosecution and incarceration for years and years.

The reason and the purpose of the petition is to compensate victim of legal system, and those accused who were acquitted after being in jail for many years and who have lost their respect.

According to petitioners, the state Government with central Government should prepare a scheme for providing funds for them purpose of compensation to the victim.  According to petitioner, when people who are wrongfully prosecuted languishing in jail, it violates their fundamental right to life and liberty under article 21 of constitution of India, and also violates their right to equality under article 14 of the constitution. 

Therefore, in these kind of situations some amount of compensation scheme would help the victim to gain back their reputation which they lost.

The petition has been filed by Advocate Mithilesh Kumar Singh.
