Separation of power between the UGC and the Bombay HC.

The University Grants Commission filed an affidavit for replying to the plea which challenges its issue that has directives for mandate examinations for the final year students till September 2020.

The UGC has told the High Court of Bombay that Maharashtra Government’s Resolution to allow Universities and Colleges to graduate its final year students without final year examinations are legislatively incompetent.

The UGC replied to the PIL filed under Dhananjay Ragunath Kulkarni v. State of Maharashtra and Ors.

The UGC argued that the Constitution of India has been based on the separation of power between, the judicial, the legislature and the executive. Hence, the role of UGC to coordinate and determine education standards is only conferred upon the Parliament. The commission has bonafide intention while its Guidelines were framed to protect the future of students.

UGC point out that the Court of Law has the well-established rule not to ordinarily intervene in academic decisions and policy, nor do they normally substitute the view of expert bodies.
