225 Supreme Court lawyers to urge for continuance of virtual hearings

The impact of Corona Virus and the on-going pandemic has brought down almost every industry and filed to the rock bottom let alone the Courts. In such torment situation, the concept of ‘Virtual Hearings’ of Courts was put forth in to the picture. It has been months now, and the cases of Covid-19 are unstoppable. In such crisis, a group of 225 Supreme Court Lawyers made a representation to a Seven-Bench judge of the Supreme Court to consider the on-going pandemic at hand and thereby order for the continuation of the Virtual Hearing approach.

Varying from the views as of late communicated by the Supreme Court Bar Affiliation (SCBA) and the Supreme Court Advocates on Record Affiliation (SCAORA) on resumption of physical hearing of issues, the representation raises concern over the developing number of COVID-19 cases, particularly in Delhi. On the off chance that physical working resumes, it’ll result within the hazard of “transmission of disease” to courts, states the letter.

The lawyers’ representation stated that, the number of people getting contaminated with the Infection has expanded to around 67,000 per day as on 14th August, 2020 with Delhi appearing an increment by around 1100 people. The number of contaminated people is anticipated to extend each day and may reach 1,00,000 in another 10 days. This increments the hazard of transmission of contamination to Courts by the time physical hearing is continued. This will uncover Hon’ble Judges, Court room staff and legal counselors contending things to expanded hazard of contracting the contamination.

The plea by the lawyers was made in order to prevent the spread of virus, considering the growth rate of the same in Delhi. In order to avoid future growth, the plea it in claim stated that the virtual hearing that has been taking place since March, is the best form of giving justice considering the present situation. 

Before this plea, the seven-bench judge committee was considering the resumption of physical functioning of the court and the hearings. However, this plea has taken a new turn. Let us see what the top court has to say it its future hearings.
