SC : State government have the right to fix the fee for giving a special registration number to the motor vehicles registered

A petition has been filed by Rakesh Sethi who could not get the registration number of his choice for his motorcycle. On Wednesday , the Supreme Court said that the state governments have the right to fix the fee for giving a special registration number to the motor vehicles registered in their area.

The bench led by Justice L Nageswara Rao and Justice S Ravindra Bhat, while accepting the appeal of the state government, said that the decision of the High Court is overruled.

The Madhya Pradesh High Court had said that the central government has the right to fix the fees for the registration application while apex court quashed a decision of the High Court which rejected Rule 55A of the Motor Vehicles Rules, 1994, framed by the state government. SC allowed the state government to charge a special fee for a particular or fancy registration number as per the wishes of the vehicle owners . According to Section 211, 41(13), 47(7), 49(4) and 50(5) of Motor Vehicle Act empowers the State to claim or charge amounts is specifically recognized by express provision.

The Rule 55A, proposed  in 2001,  stipulated four different fees: Rs 15,000 for the registration marks 1 to 9 in any series prevalent within the jurisdiction of the registering authority; Rs 12,000 for reservation of marks from 10 to 100 in any series within the jurisdiction of the registering authority. For reservation of large series of numbers mentioned in Rule 55A(c), Rs 10,000/- and Rs 2,000 for reservation of any other number or numbers within 1000 from the last number assigned in the serial order.
